The Stephens’ – 1925

This is a transcription of the deed transferring the title 212 1st Avenue SW from Wynell (single) and Ada (widowed) Stephens, to W.A. Lewis in April 1925.

WARRANTY DEED :

ADA STEPHENS at el., To. W.A. LEWIS

THIS INDENTURE, Made the L8th day of April, in the year of our Lord One Thousand Nine Hundred and Twenty-five, between Wynell Stephens, (Single) of the County of Fulton & State of Georgia, and Ada Stephens, (Widow) heirs at law of C. A. Stephens, deceased, of the County of Hamilton and the State of Florida, parties of the first part, and W. A. Lewis, of the County of Hamilton and State of Florida, party of the second part,

WITNESSETH, That the said parties of the first part, for and in consideration of the sum of Thirty-Five Hundred Dollars, lawful money of the United States of Amercia, to them in hand paid by the said party of the second party, at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged have granted, bar gained, sold, conveyed, and confirmed, and by these presents do grant, bargain, sell, convey, and confirm, unto the said party of the second part, and to his heirs and assigns, forever, all the following piece, parcel, lot, or tract of land, situate, lying and being in the County of Hamilton and State of Florida, and described as follows:—-

—-The C.A. Stephens Lot bounded on the North by lands of P.H. Sandlin, on the East by Court House Avenue, on the South by Rice Street, and on the West by ditch running from P.H. Sandlin’s land to Rice Street, and further known as that part of Lot 36 of Tompkins Survey of the Town of Jasper, Florida, lying East of said ditch, lying and being in the Town (now City) of Jasper, Florida:—–

togeather with all and singular tenements, hereditaments and appurtenances thereunto belonging or appertaining and every right, title or interest, legal or equitable, of the said parties of the first part, of, in, and to the same.

TO HAVE AND TO HOLD THE SAME, unto the said party of the second part, and his heirs and assign to their own proper use, benefit and behoof, forever. And the said parties of the first part, for themselves and their heirs, executors and administrators, do hereby covenant that said parties of the of the first part, at the date hereof are lawfully seized in fee simple of the above described premises, and are in peaceable and undisputed possession of the same; that said party of the second part, his heirs and assigns, shall at all times hereafter, have peaceable possession of said premises, without suit, eviction or disturbance of the said parties of the first part, or any person lawfully claiming the same; that said premises are free from all incumbrances and liens of every nature and kind soever, including taxes.

And the said parties of the first part for themselves and their heirs, the above described premises and every part and parcel thereof, with the appurtenances, unto the said party of the second part, his heirs and assigns, against the said parties of the first part and their heirs and against all and every person or persons lawfully claiming or ‘to’ claim the same, shall and will warrant, and by these presents forever defend.

I hereby certify that on the 18th day of April 1925, before me, The undersign authority personally appearedWynell Stephens (Single) to me known to be the person described in, and who executed the foregoing instrument, and severally acknowledged the execution there of to be her free act and deed, for the uses and purposed therein mentioned.

A round stamp with the word “REVENUE” at the top and the word “STAMPS” at the bottom is on the second page of the deed. The amount $2.50 is handwritten in the middle of the stamp.
