The Smith’s – 1904

This is a transcription of the deed transferring title of 212 1st Avenue SW from Florence and Jno F Smith, Jr, to Cleon A Stephens in August 1904.

THIS INDENTURE, Made this 25th day of August A.D. 1904 between Florence Smith & Jno F Smith, Jr of the County of Hamilton in the State of Florida, partys of the first part, and Cleon A Stephens of the County of Hamilton in the State of Florida, party of the second part, witnesseth:

That the said partys of the first part, for and in consideration of the sum of Three hundred Dollars, to ?????? in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, has granted, bargained and sold to the said party of the second part, his heirs and assigns forever, the following described land, to wit:

The B B Blackwell lot Bounded on the North by lands of P H Sandlin, on the East by Court house Avenue, on the South by Rice Street, on the West by a ditch running from P H Sandlins land to Rice Street, and further known as that part of Lot 36 of Tompkins Survey of the Town of Jasper Florida, lying East of said Ditch, Lying and being situate in the Town of Jasper Florida.

And the said party of the first part does hereby fully warrant the title to said land, and will warrant and defend the same against the lawful claims of all persons whomsoever.

IN WITNESS WHEREOF, the said parties of the first part hereunto set their hand and seal the day and year first above written.

I HEREBY CERTIFY, That on this 25th day of August 1904 before me H ??? Stewart personally appeared Jno F Smith Jr and Florence Smith, his wife, to me known to be the person described in, and who has executed the foregoing instrument, and severally acknowledges the execution thereof to be their free act and deed for the uses and purposed therein mentioned; and the said Florence Smith, wife of the said Jno F Smith acknowledge that she made herself a party to the said Deed, for the purpose of renouncing and relinquishing her dower, or right of dower, in and to the lands, tenements and hereditaments therein described, and thereby granted and released, and that she executed said Deed freely and without any fear or compulsion of her said husband.

BE IT REMEMBERED, That on the 26th day of August A.D. 1904 the foregoing instrument of writing was presented and filed for record with the subscriber, Clerk of the Circuit Court for said County, and, the same being property authenticated, I have duly recorded the same in Deed Book “P” on page 179.

On the left hand side of the page near the words “Notary Public” is a small cloud shaped scribble with the word “Seal” handwritten inside it. This same symbol in near the very bottom left hand side of the page, even with the signatures of the Clerk and Deputy Clerk.
